MyPKU Terms of Service

1. Acceptance of Terms

By downloading, installing, or using MyPKU ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Eligibility

You must be at least 16 years old to use this App. If you are under 16, you may only use the App under the supervision of a parent or legal guardian who agrees to these terms on your behalf.

3. Medical Disclaimer

MyPKU is an informational tool designed to assist in tracking dietary phenylalanine (Phe) intake. It is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional or metabolic dietitian for medical guidance regarding Phenylketonuria (PKU) management. We are not responsible for any health decisions made based on data displayed in the App.

Nutritional values, including Phe content, may be approximate. Values marked with "~" are estimated from protein content and may differ from actual laboratory-measured values.

4. User Accounts and Authentication

Certain features (Shared Groups) require signing in with a Microsoft account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and current information when creating or using your account.

5. Premium Subscriptions

Some features require an active premium subscription. Key terms:

• Subscriptions are billed through Google Play Store or Apple App Store.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel subscriptions in your device's store account settings (Google Play or App Store).
• Refunds are handled by the respective store according to their refund policies. We do not process refunds directly.
• Prices may vary by region and are displayed in your local currency in the app before purchase.

6. Your Content and Data

You retain ownership of all data you enter into the App (diary entries, products, profiles). We do not claim any intellectual property rights over your content.

You are responsible for maintaining backups of your data. You can export your data at any time using the Backup feature in Settings. We are not liable for data loss due to device failure, app uninstallation, or any other cause.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to interfere with, compromise, or disrupt the App or its backend services.
• Share inappropriate or harmful content through Shared Groups.
• Reverse-engineer, decompile, or disassemble the App.

8. Account Termination

You may stop using the App at any time by uninstalling it. To delete your cloud data (Shared Groups), contact us at contact@deployit.ovh.

We reserve the right to suspend or terminate access to cloud features if these terms are violated.

9. Intellectual Property

The App, its design, code, and branding are the property of DeployIT. USDA and CoFID nutritional data are used under their respective public domain and open government licences.

You may not copy, modify, distribute, or create derivative works of the App without written permission.

10. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or that nutritional data will be completely accurate.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to health-related decisions made based on App data.

Our total liability for any claim shall not exceed the amount you paid for the App in the 12 months preceding the claim.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the European Union and the Republic of Poland, without regard to conflict of law provisions.

Any disputes arising from these terms shall be resolved in the competent courts of Poland, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

13. Changes to Terms

We may update these terms from time to time. The "Last updated" date at the top indicates when changes were made. We will notify users of material changes through the App. Continued use after changes constitutes acceptance of the updated terms.
